Important Notice: These terms constitute a legal agreement between you and TOSEV Ltd. Please read them carefully before requesting a quote or engaging our services.

1. Acceptance of Terms

TOSEV Ltd ("we", "us", "our") is a company registered in England and Wales (Company Registration Number: 16928368). These Terms of Service govern your use of our services and website.

By requesting a quotation, submitting items for engraving, or using our services, you ("the customer") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all customers, whether individuals, businesses, or organizations.

2. Services Provided

TOSEV Ltd provides bespoke UV laser engraving services for technology products, luxury items, and corporate projects. Our services include:

  • Custom laser engraving on customer-supplied items
  • Custom laser engraving on TOSEV Ltd supplied materials
  • Design consultation and artwork preparation
  • Quote-based pricing (no fixed catalog pricing)

All work is bespoke and subject to individual quotation. We do not operate a catalog-based pricing system.

3. Quotations

  • All quotations are valid for 30 days from the date of issue
  • Quotations are subject to inspection and assessment of the actual items to be engraved
  • Final pricing is confirmed before work commences and may differ from initial estimates if item condition or specifications vary from those described
  • Quotations do not constitute a binding contract until accepted by both parties
  • We reserve the right to decline projects at our discretion

4. Customer Obligations

As a customer, you agree to:

4.1 Item Condition

  • Provide items in clean, undamaged condition suitable for engraving
  • Accurately describe the condition and specifications of items when requesting a quote
  • Disclose any defects, damage, or modifications to items

4.2 Design Approval

  • Review and approve design proofs before work commences
  • Provide written confirmation of design approval (email acceptable)
  • Acknowledge that approved designs cannot be changed once engraving begins

4.3 Intellectual Property

  • Ensure you own or have obtained necessary permissions for all designs, logos, and copyrighted material
  • Provide vector files or high-quality artwork suitable for engraving
  • Indemnify TOSEV Ltd against any intellectual property claims arising from your designs

5. Intellectual Property Rights

You warrant that you own or have obtained all necessary rights, licenses, and permissions for any designs, logos, text, or images you submit for engraving. You agree to indemnify and hold harmless TOSEV Ltd from any claims, damages, or legal actions arising from intellectual property infringement.

All engraved items remain your property. We do not claim ownership of your designs or the final engraved products.

6. Payment Terms

  • Payment: Full payment is required upfront before work commences, unless otherwise agreed in writing for larger orders
  • Payment Methods: Bank transfer (BACS), Stripe payment link
  • Late Payment: Persistent non-payment may result in future business being declined
  • Non-Payment: Items will not be released until full payment is received

7. Cancellation & Refunds

7.1 Cooling-Off Period (Consumer Contracts Regulations)

If you are a consumer (not a business), you have a 14-day cooling-off period from the date you accept our quotation. You may cancel the contract within this period for a full refund, provided work has not commenced. Once work begins, the cooling-off period no longer applies due to the bespoke nature of our services.

7.2 Cancellation After Work Commences

  • Deposits are non-refundable once work has commenced
  • Completed work is not subject to refund due to the bespoke, personalized nature of engraving services
  • If you cancel a project mid-way, you will be charged for work completed to that point

7.3 Our Right to Cancel

We reserve the right to cancel or refuse projects if items are unsuitable for engraving, designs violate intellectual property rights, or for any other reasonable cause. Full refunds will be provided if we cancel a project.

8. Liability & Warranty

8.1 Quality Guarantee

We guarantee the quality of our engraving work. If engraving does not meet our professional standards due to our error, we will re-engrave the item or provide a refund at our discretion.

8.2 Limitation of Liability

  • We are not liable for damage to items with pre-existing defects or damage not disclosed to us
  • Our maximum liability is limited to the project value (amount paid for the engraving service)
  • We are not liable for consequential losses, loss of profits, or indirect damages
  • Nothing in these terms excludes our liability for death or personal injury caused by negligence

8.3 Item Suitability

While we exercise professional care and skill, we cannot guarantee that all items are suitable for laser engraving. Some materials or finishes may react unpredictably. We will advise if we believe an item is unsuitable, but final responsibility rests with you to approve proceeding with engraving.

9. Item Handling & Insurance

  • All items are fully insured while in our possession
  • You are responsible for ensuring adequate shipping insurance when sending items to us
  • We require proof of postage for all items sent by post or courier
  • Items left uncollected for more than 30 days after completion may incur storage fees
  • We are not responsible for items lost or damaged in transit unless we arranged the shipping

10. Delivery & Timelines

  • Project timelines are estimates and not guarantees unless expressly stated in writing
  • Typical turnaround is 5-7 business days, but complex projects may require longer
  • We will keep you informed of progress and notify you of any delays
  • UK shipping via Royal Mail Special Delivery or similar tracked, insured service
  • International shipping via DHL/UPS at additional cost (quoted separately)
  • Risk passes to you upon delivery or collection

11. Governing Law & Disputes

These Terms of Service are governed by the laws of England and Wales. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.

We encourage customers to contact us directly to resolve any concerns before pursuing formal legal action.

12. Force Majeure

We are not liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, labor disputes, or supply chain disruptions. In such events, we will notify you promptly and resume services as soon as reasonably possible.

13. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on our website with a new "Last Updated" date. Continued use of our services after changes constitutes acceptance of the updated terms. Projects already agreed upon will be governed by the terms in effect at the time of acceptance.
